These Terms and Conditions of Sale (“Terms”) govern your use of the baristaemporium.com/ website (“Site”) and your purchase of products from HUB 92 SL.

For the purpose of these Terms, HUB 92 SL shall be referred to as “the Company.” By placing an order with the Company, you agree to be bound by these Terms.

2. 💰 Product, Pricing, and Order Acceptance

2.1. Price and Taxation

• All prices displayed on the Site are stated in EURO and include Value Added Tax (VAT), in accordance with applicable Spanish and EU legislation.

• Shipping and delivery charges are not included in the product price and will be clearly displayed and calculated at the checkout stage before final payment.

2.2. Pricing Policy and Errors

The Company reserves the right to change product prices at any time without prior notice. In the event of an obvious pricing error on the Site, the Company reserves the right to correct the error and inform the customer. If the customer does not accept the corrected price, the order will be cancelled and any funds paid will be refunded.

2.3. Contract Formation and Acceptance

• The display of products on the Site constitutes an invitation to treat and not a binding offer to sell.

• Your order constitutes an offer to purchase the products from the Company.

• An order is considered officially accepted and the contract formed only when payment has been successfully processed and you receive an Order Confirmation email from the Company. The Company reserves the right to decline any order for any reason prior to acceptance.

3. 📦 Shipping, Delivery, and Risk

3.1. Delivery Times

Delivery times provided are estimates only and are not guaranteed. The Company is not liable for any delays in delivery caused by the courier, customs, or circumstances beyond our reasonable control.

• Estimated Delivery Times:

  • Europe: 5–7 working days

  • International: 8–12 working days

3.2. Risk of Loss and Insurance

All shipments are fully insured. The risk of loss or damage to the product transfers to you, the customer, upon delivery of the product. If a product is lost or damaged during shipment, you must notify the Company immediately so we can file a claim with the courier and arrange a replacement or refund, as the shipment is insured.

3.3. International Shipping, Duties, and Taxes

• The Company offers international shipping outside of Spain.

• For all international orders, the customer is the importer of record and is responsible for all customs duties, import fees, local sales taxes, and clearance charges levied by the destination country. These charges are not included in the product price or shipping costs paid to the Company.

4. ⚙️ Warranties and Limitation of Liability

4.1. Manufacturer’s Warranty

All espresso machines and related equipment are sold with a Manufacturer’s Warranty.

• The Company is not the warrantor. Any defect, fault, or claim under the warranty must be directed to the original product manufacturer (e.g., La Marzocco, Breville, De’Longhi).

• Your legal warranty rights under EU law (usually three years for conformity of goods) remain unaffected.

4.2. Disclaimer of Implied Warranties

To the maximum extent permitted by applicable Spanish and EU law, the Company expressly disclaims all implied warranties, including but not limited to the implied warranties of merchantability and fitness for a particular purpose.

4.3. Limitation of Liability

In no event shall the Company be liable for any indirect, incidental, or consequential damages. The Company’s total maximum liability to you for any damages arising out of or related to these Terms, the products, or the use of the Site shall be limited to the following:

• The total purchase price of the product giving rise to the claim; OR

• A maximum amount of €2,000 EURO, whichever is lower.

5.1. Intellectual Property Rights (IP)

All content on the Site, including but not limited to text, logos, graphics, images, product photography, and site design, is the property of the Company or its content suppliers and is protected by Spanish and International Intellectual Property Laws. The content may not be used, reproduced, or copied without the Company’s express written permission.

5.2. Account Termination and Suspension

The Company reserves the right to suspend or terminate your account access to the Site without prior notice if you breach these Terms, including but not limited to:

• Failure to make payment when due.

• Misuse of the Site (e.g., data scraping, introducing viruses).

• Engaging in fraudulent or illegal activity.
